Agreement to Terms

Welcome to Radiant Rushs. These Terms of Use ("Terms") govern your access to and use of the Radiant Rushs streaming service, website, and applications (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

Service Description

Radiant Rushs provides a subscription-based streaming service that allows members to access entertainment content, including movies, television shows, and other video content (collectively, "Content") via internet-connected devices.

Our Service is personalized based on your viewing preferences and activities. We continually update and modify our Content catalog, and the availability of specific titles may vary based on licensing agreements and geographic restrictions.

Eligibility and Account Registration

To use Radiant Rushs, you must be at least 18 years old and capable of entering into legally binding contracts. By creating an account, you represent and warrant that you meet these requirements.

When registering, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

Each account is for personal, non-commercial use only. Account sharing is permitted within your household, subject to the simultaneous stream limitations of your chosen subscription plan.

Subscription and Billing

Subscription Plans: We offer multiple subscription tiers with varying features, streaming quality, and simultaneous stream allowances. Current plan details and pricing are available on our website and may be modified from time to time with notice to subscribers.

Billing Cycle: Your subscription begins when you complete the signup process and provide valid payment information. You will be charged the subscription fee on a monthly recurring basis until you cancel your subscription.

Payment Methods: We accept major credit cards and debit cards. You authorize us to charge your chosen payment method for all fees associated with your subscription. If your payment method fails, we may suspend your access to the Service until payment is successfully processed.

Price Changes: We reserve the right to adjust subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle after the notice period. Your continued use of the Service after a price change constitutes acceptance of the new price.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to the Service until that time. No refunds or credits will be issued for partial subscription periods.

Use of the Service

License Grant: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and view Content through the Service for your personal, non-commercial use. This license does not include the right to download Content (except for authorized offline viewing features), reproduce, distribute, modify, or create derivative works.

Restrictions: You agree not to:

• Use the Service for any commercial purpose or public performance
• Circumvent, remove, alter, or interfere with any content protection, digital rights management, or geographic restrictions
• Access the Service through automated means or bots
• Share your account credentials with anyone outside your household
• Attempt to decompile, reverse engineer, or extract source code from the Service

Geographic Limitations: Content availability varies by geographic region due to licensing restrictions. You may not use VPNs, proxies, or other methods to circumvent geographic restrictions.

Content and Intellectual Property

All Content available through Radiant Rushs, including videos, audio, text, graphics, logos, and software, is owned by or licensed to Radiant Rushs and is protected by copyright, trademark, and other intellectual property laws.

You acknowledge that you acquire no ownership rights by accessing or using the Content. All rights not expressly granted in these Terms are reserved by Radiant Rushs and its licensors.

The Radiant Rushs name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Radiant Rushs or its affiliates. You may not use such marks without our prior written permission.

User Conduct

You are solely responsible for your conduct while using the Service. You agree to use the Service in compliance with all applicable laws and regulations and in a manner that does not:

• Infringe upon the rights of others
• Harass, abuse, or harm others
• Violate privacy rights
• Distribute spam or malicious code
• Impersonate others or misrepresent your affiliation
• Interfere with or disrupt the Service or servers

Parental Controls and Content Ratings

Our Service includes content suitable for various age groups. We provide parental control features that allow account holders to restrict access to content based on maturity ratings.

Account holders who provide access to minors are responsible for determining what content is appropriate and for implementing appropriate parental controls. Content ratings are provided for informational purposes and may not reflect all potentially sensitive material.

Third-Party Services and Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Radiant Rushs. We have no control over and assume no responsibility for the content, privacy policies, or practices of third-party sites or services.

You acknowledge and agree that Radiant Rushs shall not be responsible or liable for any damage or loss caused by your use of third-party services.

Disclaimers and Limitation of Liability

Service Availability: While we strive to provide continuous, error-free service, we do not guarantee that the Service will be uninterrupted, timely, secure, or free from errors, viruses, or other harmful components. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

Content Accuracy: We do not warrant the accuracy, completeness, or usefulness of Content, and you rely on such Content at your own risk.

Limitation of Liability: To the maximum extent permitted by law, Radiant Rushs and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of the Service.

In no event shall our total liability to you for all damages exceed the amount you paid to Radiant Rushs in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Radiant Rushs and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in fraudulent or illegal activity.

Upon termination, your right to access the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada.

Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We may also modify these Terms at any time by posting the revised Terms on our website. Material changes will be communicated to you via email or prominent notice on the Service.

Your continued use of the Service after modifications become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Radiant Rushs regarding the Service and supersede all prior agreements and understandings, whether written or oral.
